Hereinafter referred to as "the Seller".
These general terms and conditions of sale, hereinafter referred to as the "GTC", define the rights and obligations of the Seller and its customers in the context of the sale of products and, where applicable, associated services offered by Alu Floors Scandinavia.
They apply to orders placed on the website, by email, by telephone or by acceptance of a quote.
The customer must indicate whether they are acting as a consumer, a professional, or on behalf of a legal entity. Certain legal provisions, notably the right of withdrawal and the legal guarantee of conformity, are reserved for consumers.
All orders imply acknowledgment and unreserved acceptance of these General Terms and Conditions. Any specific conditions appearing on a quote or order confirmation shall prevail over these General Terms and Conditions in the event of any conflict.
Alu Floors Scandinavia offers equipment and accessories for swimming pools, wellness areas and outdoor spaces: shelters, covers, mobile terraces, aluminum flooring, technical equipment, heat pumps, water treatment solutions, spas, saunas, coatings and installation products.
The essential characteristics of the product are presented on its datasheet, in the quote or in the manufacturer's documentation.
Photographs and representations are for illustrative purposes only. Slight differences in color, finish, or presentation may exist, without affecting the essential characteristics of the product.
Before ordering, the customer must verify that the product meets their needs, installation requirements, and project constraints. Alu Floors Scandinavia may request additional dimensions, photographs, plans, or technical information.
Some products are manufactured according to the dimensions, choices, colors, technical characteristics or instructions provided by the customer.
The client is responsible for the accuracy of the measurements, plans, and information they provide. They must carefully review the summary, quote, or manufacturing plan before giving their approval.
Manufacturing only begins after:
Any modification requested after production has begun is subject to the manufacturer's approval. It may result in additional costs and a longer delivery time, or be technically impossible.
Offers are valid while stocks last and within manufacturers' production capacities.
When a product becomes unavailable after an order has been placed, the Seller will inform the customer as soon as possible. A replacement may be offered. The customer is free to refuse the replacement and receive a refund of the amounts paid for the unavailable product.
For custom-made products, delivery times are provided in the quote or order confirmation, subject to receipt of the necessary information, validations and payments.
The applicable prices are those displayed on the website or indicated in the quote at the time of ordering.
For consumers, prices are shown inclusive of all taxes where the applicable tax can be determined. For businesses, prices may be shown excluding taxes, with the applicable VAT being added at the time of invoicing.
Delivery, handling, customs fees or any other additional expenses are indicated to the customer before final validation of their order or in the quote.
For international deliveries, applicable taxes and formalities depend on the destination country. The relevant conditions are specified before the order is finalized.
The Seller may change its prices at any time, without affecting orders already confirmed.
The professional client must provide their company name, address, SIRET number or registration number and, where applicable, their intra-community VAT number.
Depending on the product, the quantities ordered and the conditions granted by the supplier, a trade discount may be offered to professionals.
This discount is neither automatic nor retroactive. It is only applicable when expressly stated on the quote or order confirmation.
The order becomes final after:
The Seller sends the customer an order confirmation or an accepted quote on a durable medium, including by email.
The Seller may request additional information or refuse an order for a legitimate reason, including in the event of unavailability, technical impossibility, inaccessible delivery address, payment incident or suspicion of fraud.
The validity period of a quote is that which is stated on the quote itself.
Payment can be made, depending on the means available at the time of ordering, by:
The availability of certain payment methods depends on the country, the amount, the currency and the conditions of the service provider concerned.
The installment or deferred payment options offered by Alma or Klarna are subject to the customer's acceptance by the service provider. Alu Floors Scandinavia does not guarantee their availability or acceptance.
For payment by bank transfer, the order is considered settled only after actual receipt of funds in HAPPYDKO's bank account.
The Seller may suspend preparation, manufacturing or shipping in the event of refused, incomplete, late payment or payment that is reasonably suspected of fraud.
Unless otherwise specified in the quote, custom-made products are paid for according to the following schedule:
Production will only begin after the deposit has been received. The product can only be shipped after the balance has been received.
A different payment schedule may exceptionally be agreed upon. It must then be expressly mentioned in the quote or order confirmation.
Any sum not paid by a professional client on its due date will result, from the day after the due date and without prior notice, in the application of penalties calculated at a rate of three times the legal interest rate.
A fixed fee of 40 euros for recovery costs is also payable. Additional compensation may be claimed upon presentation of supporting documents when the actual recovery costs incurred exceed this amount.
The products remain the property of HAPPYDKO until full payment of the price.
For consumers, this clause does not alter the legal rules regarding the transfer of risk. The risk of loss or damage is transferred to the consumer when they take physical possession of the product or when it is handed over to a third party they have designated.
Products can be delivered to France, to countries of the European Union and to the United Kingdom, subject to their availability, their nature, their dimensions and the accessibility of the address.
Some heavy, bulky or custom-made products may be subject to geographical restrictions or special transport conditions.
Delivery to another destination may exceptionally be considered upon request, without guarantee of acceptance.
The delivery date or timeframe is indicated before order confirmation or in the quote.
The time period begins after receipt of the necessary payment and, for a custom-made product, after final validation of all technical information.
If no deadline has been given to the consumer, delivery will take place at the latest within thirty days of the conclusion of the contract, unless otherwise agreed between the parties.
In the event of a delay, the consumer has the remedies provided by the Consumer Code. In particular, they can request performance within a reasonable additional period and, if delivery does not occur, terminate the contract under the legal conditions.
Some products are delivered on pallets or by a specialized carrier.
The customer must provide a complete, accessible address suitable for the vehicle used. They must inform the Seller of any particular constraints: narrow street, tonnage restrictions, lack of access for a truck, slope, floor, gate, construction site or other obstacle.
Unless otherwise stated in the quote, delivery will be made to the address provided, at a point accessible to the carrier's vehicle. Unpacking, moving the goods within the property, handling them to the installation site, and assembly are not included.
When the client's presence is required, they must be available at the agreed-upon appointment. Fees resulting from an absence or incorrect access information may be charged to the client if they have been notified and justified.
The customer is advised to check the apparent condition of the packaging and products upon delivery.

The absence of reservations with the carrier does not deprive the consumer of their legal guarantees.
Any complaint can be sent to alu.floors.s@gmail.com, with the order number, a description of the problem and, where possible, photographs.
For standard products purchased remotely, the consumer has a period of fourteen days from receipt of the product to exercise their right of withdrawal, without having to justify their decision.
For an order including several products delivered separately, the period begins upon receipt of the last product concerned.
The consumer must submit, before the expiry of the period, the form appearing at the end of these Terms and Conditions or any declaration clearly expressing their wish to withdraw.
Simply refusing the package or returning it without prior declaration is not sufficient to exercise the right of withdrawal.
In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal cannot be exercised in particular for goods made to the consumer's specifications or clearly personalized.
This exclusion may apply, depending on their configuration:
The customer is informed of this lack of right of withdrawal before the order is validated, in particular in the quote or the product sheet.
This exclusion does not eliminate the applicable warranties in case of defect, damage or non-conformity.

Depending on the nature or origin of the product, another address may be provided, particularly when the return must be made to a warehouse or a partner manufacturer.
The product must be returned no later than fourteen days after notification of the decision to withdraw.
The customer must take the necessary precautions to protect the product during transport. They may only handle the product to the extent necessary to verify its nature, characteristics, and operation.
In the event of cancellation, the direct costs of return shipping are borne by the customer, unless otherwise stated or the error is attributable to the Seller. For bulky items that cannot normally be returned by mail, the estimated cost of return shipping must be communicated to the consumer before the order is placed.
In the event of a valid withdrawal, the Seller shall reimburse the sums paid, including the delivery costs corresponding to the standard delivery method offered, no later than fourteen days following receipt of the request.
The refund may be deferred until the product is received or until proof of shipment is provided, whichever occurs first.
Additional costs resulting from choosing a delivery method more expensive than the standard method are not refundable.
The refund will be issued using the same payment method, unless the customer expressly agrees to another method at no extra cost.
Depreciation may be considered when it results from handling beyond what is necessary to verify the nature, characteristics and functioning of the product.
The consumer benefits from the legal guarantee of conformity under the conditions provided for in Articles L.217-3 et seq. of the Consumer Code.
The consumer has two years from the date of delivery of the product to take action in the event of a lack of conformity.
The customer may request repair or replacement of the product, subject to the cost and feasibility conditions stipulated by law. If these solutions are impossible, delayed, or cause significant inconvenience, the customer may be entitled to a price reduction or termination of the contract under the applicable legal conditions.
The legal guarantee of conformity is provided by the Seller, independently of any commercial guarantee that may be offered by the manufacturer.
The customer also benefits from the guarantee against hidden defects provided for in articles 1641 to 1649 of the Civil Code.
He can choose between rescinding the sale or reducing the price when he demonstrates the existence of a hidden defect, sufficiently serious and prior to the sale.
The action must be initiated within two years of the discovery of the defect.
Some products benefit from a commercial warranty granted by their manufacturer.
Its duration, scope, exclusions and terms are specified in the product documentation or warranty contract.
The commercial warranty is in addition to the legal warranties and cannot replace or limit them.
When installation is not expressly included in the quote, it remains the responsibility of the client.
The customer must comply with the instructions, safety rules, manufacturer's requirements, and applicable regulations. It is their responsibility to call upon a qualified professional when the nature of the product, the connections, or the regulations so require.
The Seller cannot be held responsible for improper installation, use contrary to instructions, insufficient maintenance or unauthorized modification of the product, subject to legal guarantees and its own obligations.
When the installation is sold or carried out under the responsibility of the Seller, the corresponding legal obligations remain fully applicable.
The Seller is responsible for the proper performance of its contractual obligations under the conditions provided by law.
It cannot be held liable for damage resulting from erroneous information transmitted by the client, improper use, unauthorized intervention or an external event which is not attributable to it.
Nothing in these Terms and Conditions limits the consumer's legal rights or the Seller's liability where it cannot be legally excluded.
Neither party shall be held liable for any delay or failure to perform resulting from an event meeting the criteria of force majeure as defined in Article 1218 of the Civil Code.
The affected party shall inform the other party as soon as possible. When the impediment is temporary, performance shall be suspended. When it is permanent, the contract may be terminated under the conditions provided by law.
The information collected is used to process requests, orders, payments, deliveries and customer relations.

The texts, photographs, graphics, logos, documents and content on this site are protected by intellectual property laws.
Any unauthorized reproduction, adaptation, extraction or use is prohibited, except with the prior written consent of the rights holder.

The customer must specify their identity, order or quote number, the product concerned and the nature of their request.
After sending a written complaint to the Seller and in the absence of an amicable solution, the consumer can resort free of charge to the consumer mediator to whom HAPPYDKO is subject.
The request for mediation must comply with the admissibility conditions set by the mediator.
This article must be completed before the publication of these Terms and Conditions.
These Terms and Conditions are governed by French law.
For consumers residing in another country, this choice does not deprive them of the mandatory protection provisions provided by the law of their country of residence where applicable.
In the event of a dispute, the parties will first seek an amicable solution.
The consumer can then resort to the consumer mediator or bring the matter before the competent court in accordance with the applicable legal rules.
For disputes exclusively between professionals, and after an attempt at amicable resolution, the legally applicable rules of jurisdictional competence will be implemented.
The Seller may modify these Terms and Conditions at any time.
The version applicable to an order is the one accepted by the customer on the date of its validation. A copy may be kept or printed by the customer.
This form should only be completed and sent if the consumer wishes to withdraw from an order for which this right applies.
